Terms of Service

These Terms explain the rules for using VivoChart, what the Service does and does not do, and your responsibilities when handling health information.
1. Acceptance of Terms
By creating an account, accepting an invitation, or otherwise accessing VivoChart (the "Service"), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the Service.
The Service is operated by VIVOCHART LLC ("VivoChart", "we", "us").
2. Description of Services
VivoChart is a personal health information tool. Depending on the features available to you, it provides:
- Medical record aggregation and organization
- Laboratory result visualization and longitudinal trends
- Medical history and treatment timelines
- AI-assisted explanations of clinical information
- Patient-authorized connections to health record providers, where available
- Document uploads and health information management, including sharing access with people you invite
3. Eligibility and Account Responsibilities
You must be at least 21 years old to create an account. You agree to provide accurate account information and keep it current.
You are responsible for keeping your sign-in credentials confidential and for activity under your account. Notify us promptly at support@vivochart.com if you believe your account has been accessed without permission. Because your account contains sensitive health information, use a strong, unique password and do not share it.
5. Medical Information Disclaimer
VivoChart is an informational and educational tool. It:
- Does not replace professional medical advice, diagnosis, or treatment.
- Does not provide emergency medical services or continuous medical monitoring.
- Should not be used as the sole basis for any treatment decision.
Review any concerning finding with a qualified healthcare professional. In an emergency, call 911 or your local emergency number.
6. Artificial Intelligence
VivoChart uses AI to read uploaded documents, extract values, and produce summaries and explanations. AI output may contain inaccuracies, omissions, or missing context. It is not an independently validated clinical recommendation. Always verify important findings against your original records and with a qualified clinician.
7. User-Provided Data and Permissions
You may upload only records you have the right to share. If you manage another person's information, you confirm you have their permission or legal authority to do so. When you invite viewers or admins to a board, you are responsible for choosing who can see that information.
You keep ownership of your records. You grant VivoChart a limited permission to store, process, and display them solely to provide the Service to you and the people you authorize.
8. Privacy and Security
Our handling of personal and health information is described in the Privacy Policy. We use reasonable technical and organizational safeguards, but no system is completely secure and we cannot guarantee absolute security. VivoChart does not claim any HIPAA certification or FDA clearance.
9. Acceptable Use
You agree not to:
- Access accounts, boards, or data you are not authorized to access.
- Probe, scan, or interfere with the security or operation of the Service.
- Upload information about others without appropriate authority.
- Upload malicious code or use the Service for unlawful purposes.
- Reverse engineer or resell the Service except as permitted by law.
10. Third-Party Services
Delivering the Service involves third parties such as electronic health record systems, authentication and hosting providers, email delivery, and AI processors. Their services are governed by their own terms, and we are not responsible for their availability or content.
11. Availability and Changes
The Service may be interrupted for maintenance, outages, or limits imposed by third-party APIs. We may add, change, or remove features over time.
12. Account Termination and Data Deletion
You may stop using the Service at any time. To close your account and delete your data, contact support@vivochart.com; self-service account deletion is not yet available. We may suspend or end access for violations of these Terms. Deletion practices are described in the Privacy Policy.
13. Intellectual Property
VivoChart's software, design, name, and logo belong to VivoChart or its licensors. Your medical information and documents remain yours.
14. Warranty and Liability Limitations
To the extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, and we do not warrant that it will be error-free or uninterrupted. To the extent permitted by law, VivoChart is not liable for indirect, incidental, or consequential damages arising from use of the Service. Nothing in these Terms limits rights you have under applicable consumer protection law. These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules, and the state and federal courts located in Delaware have exclusive jurisdiction over any dispute arising from these Terms or the Service.
15. Changes to Terms
We may update these Terms. We will update the "Last updated" date and, for material changes, notify you by email or in the app before they take effect. Continued use after that means you accept the updated Terms.
